help my account hasbeen suspended for copyright infrigment-full bollywood movies in 3gp format. I want to say that I never hosted a single bollywood movie in x10hosting discspace. I just linked to another site. So how it is possible to violate your copyright? Please unsuspend me, it contains valuable joomla scripts i spend 100 s of hours developing my site.

The problem is it's been proven at least 3 times that it's illegal to even link to copyrighted material that is being hosted illegally. As such, x10hosting has you covered under the tos:

Illegal Material: This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State, or Local regulation. You may not store copyrighted Mp3s or videos on your webspace in any way shape or form.

That because it would be in violation of Federal regulation. This of course is a moot point since the definition of Warez is a killer:

Warez refers primarily to copyrighted works traded in violation of copyright law.
The Warez scene, often referred to as The Scene (often capitalized) is a term of self-reference used by a community that specializes in the underground distribution of pirated content, typically software but increasingly including movies and music.
While there's more than one definition of Warez, that's the one x10's been running by, which means this part of the TOS comes into play:


  • Warez: Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing, etc... This also includes any sites which provide "links to" or "how to" information about such material.
The part about "links to" is what really killed it. In any case, just it being in violation of US Federal law would've been enough.



In any case, you can dispute it if you want, but based on past suspension history involving others who were "just linking" to copyrighted material, you're more than likely stuck on zero tolerance, no unsuspension or file recovery possible.
