Hi,

I just got suspended for the following:

"February 1 at 8:24 am suspension You have been suspended for high system resource usage. Accounts are suspended for usage when they are detected to have consistently high cpu usage, memory usage, or process amounts. This is an automatic suspension, you're able to unsuspend yourself immediately. Warning 2 of 3."

What does that mean? And can I please have more than 2 minutes back on the next time I unsuspend my account, so I can backup and save my database? Thanks in advance!

Michael Brock

I unsuspended your account.

high resource usage means your script(s) are using more CPU or memory for long time

The limits are

25% CPU utilization
5% of memory
240 seconds of CPU time per hour
20 concurrent processes executing

And you were replying as I resuspended after finding a copyright infringing audio book download and a copyright infringing pdf for books that aren't free. Sorry to counter the unsuspension mbrocksworld15, but this one's permanent as we have -zero- tolerance for copyright infringement.

Well, in my defense, I do have "give away" private label rights on all the stuff I had posted, and it's all self-help books from a long time ago (i.e., "Public Domain" - COPYRIGHT EXPIRED & NO PROTECTION), and the current editors want it to be shared in order to get the word BACK out. So I disagree with that part wholeheartedly, but I'm not here to argue. No, I was just wondering if there was a way I could please get a copy of the latest database backup? Thanks!

Hmmm... I was only running a Wordpress blog and barely had any traffic, so I'm not sure what could've been using so much resources???

The problem I'm running into on the argument here is some google searches are turning up that if they're the -original- texts it'd be debatable. The problem is we've got an audio book which appears to be from 2000, and the 21st century edition re-release of "think and grow rich". I'm still doing some more digging on this, but so far what I'm turning up is that these were reissues and thus are copyright protected just as the original books were, but I'm still looking.

If it does indeed turn out these are -still- copyright protected, the suspension is permanent and no backups can be provided. If I'm wrong, I'll gladly unsuspend the account.

"Now the classic bestseller is even better! This newly edited edition of Think and Grow Rich: The 21st-Century Edition presents the full text of the original book, and carefully integrates into each chapter new, updated examples and commentary. This edition proves on every page that Hill’s principles are as up-to-date as this mornings headlines. "

There is new updated information in the 21st century edition which is protected by copyright as a Derivative Work.

In United States copyright law, a derivative work is an expressive creation that includes major, copyright-protected elements of an original, previously created first work.

The suspension stands as a permanent suspension as the e-book provided for download is -not- the one in Public Domain. It is a copy protected book first issued in 2004.

Near as I can tell, the same stands for the Audio book as it's considered a derivative work. Hardly matters since the other one has been confirmed to be squarely in violation of US Copyright Law.

Edit: realized after re-reading that initial quote for derivative work doesn't seem to make sense. Found a bit better one.

The copyright in a derivative work covers only the additions, changes, or other new material appearing for the first time in the work. It does not extend to any preexisting material and does not imply a copyright in that material.

In this case the new content in the book is what's covered; the original contents of "think and grow rich" -are- public domain, but not the new stuff.

Hey Livewire,

Well, all the materials in question are included in my lifetime membership to either The Secret Pays, Push-button Publishing or any one of a few other PLR membership sites that I belong to. Moreover, I downloaded a lot of the stuff to my HD a while ago (e.g., about 7 or 8 years), which has actually become a slave drive since I got another computer, and so I forgot exactly where I got everything from. Anyway, here again, I'm not trying to argue, rather I'm just trying to make my point clear that, as I understand it, the materials are not copyright protected to the best of my information, knowledge and belief. They were all in folders clearly labeled PLR / MRR, which I do remember only contains things that I can give away freely and/or alter in any way I wish. In fact, I could just create my own PDF file of the old text, make some changes and Copyright that edition, claiming it as my own derivative work. Shoot, I think I'm going to do that, just so I can avoid this in the future. Same goes for the audio-book version of the Law of Success in Sixteen Lessons, except that I don't think I'll be reproducing that anytime soon. ;)

Kind Regards,

Michael Brock

P.S. Btw, no hard feelings here either... Yeah, I realize that you're just doing your job and trying to protect the community as a whole, which I totally understand and respect. And since you see this matter differently than I do, I just want to say that I didn't mean to break the rules or didn't intentionally violate the TOS. And I still don't think that I did, because I really think they not copyrighted, as I understand the terms of the PLR sites that I got the stuff from. Even so, please forgive me for doing so, as you see it! And is the ban permanent for me, or can I start another account and chalk this one up to a hard lesson learned, since I lost all the files and didn't have a backup, so I'm having to start all over with my blog? I more than willing to follow the rules of the TOS! And, of course, I wouldn't be putting anything up for download that is even questionable. In fact, is it possible to have you guys review stuff for pre-approval?
