TOS clearly says no shoutbox/chatbox scripts that use MySQL because of the amount of queries they take. This is not a suspension we can remove.

Well the TOS did explicitly indicate they weren't allowed and you still put one on there, and it did say you were responsible for all backups. If you want to move to another host that's fine, I would just advise you make sure to follow their TOS as well so a similar fate isn't met.
