is it legal, to provide an online voting on this hosting? i read tos but im not sure
people will send sms, vote counts in db, the result appears on the site and web generated pictures
which users can put into forums userbars or somewhere else

Sounds fine to me, other than that you are currently showing a permanent suspension for having a proxy on your account.
