Only if enough users do it. If enough people say that your email is spam, then it's spam. If you follow the
CAN-SPAM guidelines (no "cold" mailing, making sure the users opt-in to your mailings, and giving them an easy way to unsubscribe), there shouldn't be a problem. If you are sending mail that qualifies as spam, then you'll probably be blacklisted.
You do have to watch what you put in your mail, though -- the automatic spam filters look for words and phrases that almost never occur in mail that isn't spam (good luck if you're trying to send out a legitimate newsletter concerning Viagra, for instance). And spelling and grammar matter -- if you send out a lot of mail, all the same, that contains a lot of spelling errors, the spam filter may be triggered.
