Hello, x10! (ToS questions)

Switching over from [host removed] and I'm liking x10, so far. I have some questions about the Terms of Service. The rules themselves seem fairly strict. How strict is the enforcement?
-If I have copyrighted material on my site but I am unaware that it is copyrighted, will I still suffer a strict termination?
-If I have, say, a comment board and a user posts copyrighted material (assume efforts are made to remove but something gets missed), will I suffer the aforementioned strict termination?
-What is considered 'auto-generated content'? I have a cron that [re]generates a sitemap every week- is this not allowed?
-Direct relation to website. Does this mean everything must be used on the website? What if I have pages/images/etc. not currently in use (e.g. images that are for a page that is under maintenance or construction)?
-Are the ToS as strict on paid plans? If I pay for my hosting will I be allowed to use my hosting for storage? 8)

Hello,

Enforcement is strict here. If you're planning on breaking the rules, x10 is not for you. :)
1) You need to check that any material on your site isn't copyrighted. It's your responsibility to ensure this, however things like images we usually don't make too much of a fuss over. It's more music and videos as the files are so large.
2) You need to moderate your board. We will allow a reasonable amount of time for content to be removed, but again, all content is your responsibility. You need to have measures in place to ensure nothing "slips through the net".
3) A sitemap would be okay. Auto-generated content is things like scraping content from other blogs etc and posting it again as your own.
4) Everything on the account must be related to your site. If you're being safe, ideally it would be used on a page somewhere. If you're constructing a page behind-the-scenes, the content should still be used on that page. You can't use the hosting as a file storage service. All files ideally need to be used on your main website.
5) File hosting isn't allowed on premium either.

One more question. If my account is suspended/terminated, will my site and data be immediately demolished or will I have a notice period and/or the option to download all my data before it is removed?

Howdy;
There are different types of suspensions.
If your account is suspended for inactivity or high resource usage you will usually be able to unsuspend yourself and should that fail a community helper will be able to unsuspend your account.
Most terms of service violations are permanent suspensions but you have the right to have these suspensions reviewed by staff. TOS suspensions are seldom reversed so make sure you understand and follow the terms of service.
Suspended accounts will remain suspended for at least 14 days before being permanently terminated and deleted.
Users will not be able to access data, cPanel or FTP on suspended accounts.
Always a good idea to have local backups of your files and databases.
