Well, i don't know if just Corey could answer me that but i'll post here instead of PM'ing.


So, the question is:

I know TOS of x10 says "no copyrighted mp3". So i started reading kinds of file sharing and i figured out how copyright law works.
To mp3's, is LEGAL have any copyrighted music hosted in your website if and ONLY if the mp3 have at MAXIMUM lenght, 30 seconds. Then, you will just sharing a little of music and letting people know.

But i finded another way to share music but only works IF you OWN an ORIGINAL COPY of what you want to share. Works for Emulator ROM's (SNES rom's, GBA/GBC, etcs), MP3's and all copyrighted stuff.

The law let you have ROM/MP3 if, and ONLY IF you really OWN the original copy of the game / soundtrack. So, if i have an original Album from Rurouni Kenshin (i have lol), i can download the MP3's hosted in any website since i own that copy.

The same for hosting and sharing your mp3: So, lets take my RK album as example: I CAN host it since i own a copy of the original album. If i let people download it, i must warn that the download will only be LEGAL if they own an original copy as i, if not, they must delete within 24hours or they will became illegal to copyright law.

So the question really is:
I, owning my original copy of Rurouni Kenshin Album, can host their mp3 at x10, adding before the download button the following DISCLAIMER?

Actually, the Fair Use clause does *not* allow you to share the whole song. It only applies to copying for personal use, not to share with friends or family.

Example: I own a particular cd but I want to listen to it on my cassette walkman. I can legally copy the cd to the cassette, but I cannot legally share that cassette with anyone. They can listen to it with me, but I cannot give them the cassette.

So I *think* that your second method would not fly. Then again, I'm not a lawyer either. :)

If this is true, then i can install a RadioBlog in my webpage, since they will not be allowed to download but only listen ;)

And about bandwidth, well, will be my bandwidth limit that will goes on X.x~ Radio Blog isn't streaming, is a FlashPlayer that plays the music, so, before i upload them (in mp3), i have to convert them to a kind that *i think* only radioblog reads. Then, when someone press play, it will load the song and listen. Thats all.

Ah... but all radios, including internet ones now, must pay royalties... which amount to (often) thousands of US dollars. If you don't pay, you are in violation of the law for broadcasting said music. :biggrin:

Still, I'm sure one of the staff will give you a definite 'yay' or 'nay' on this subject. I'm just the peanut gallery, after all!

But still, a great user and a great helper!

Hmm.. I'll check about radioblog because they have tons of musics and i dont think they pay for it.
And this radioblog is an OLD software :p So, if not yet blocked, must be something they did. heh:nuts:

Faolan is correct, you are not allowed to broadcast copyrighted music without paying royalties on it. You need to get licenses to do that.

And no, you are not allowed to host the music and put a disclaimer for it. Don't you think if that worked people would be putting up copies of movies, all the software, etc... and just putting a 2 line disclaimer before it? You can not share copyrighted files on our service period. No way around it.
