My Account was Suspended - Final Questions

I recently had my x10Hosting account suspended, and as is normal, I submitted an appeal that is as follows...

I believe that my account was suspended as a result of me using it to store encrypted backups of important files on my hard drive and got too carried away with the amount of space I was using.

I apologize for using the amount of space that I did, but at the same time, using part of my account to store files was very beneficial for me. If you would like, I will gladly remove all of my old backups that I no longer need and limit myself solely to the backups that I do need, or if you would like I could terminate my use of the account for file backups immediately, which to be honest I do not want to do. Aside from using my account for storing files, I did have a legitimate website up and running and never expected that using some space for my files would cause such an issue that my account would be suspended. Please review this appeal with the understanding that no harm was meant to x10Host or its services, and even now I mean no harm.

Hello,

Thank you for submitting an appeal against the suspension imposed upon your x10Hosting free web hosting account. We have
reviewed your account and the information included within your appeal. Unfortunately after careful consideration the
information submitted with your appeal does not adequately justify removal of the suspension. Our Terms of Service clearly
states we are not a file storage service; I'm unsure exactly what caused you to attempt to store 80gb of backups on us, but
doing so has left us absolutely no choice but to immediately and permanently discontinue service to you.

In accordance with the x10Hosting Terms of Service and Acceptable Use Policy agreed to upon registration the suspension will
remain permanently. This decision is final.

At this time, data backups are not available as detailed in sections 6 and 8 of the x10Hosting Terms of Service.

I would have liked to follow up to this response with a final word, but since I was unable to, I would like to post some comments and questions here on the forums. I would like to point out that first of all, this was the first and only suspension that my account faced in two years of using x10Hosting. Secondly, although you can't really prove the truth behind it, I thought the old backups were not needed anymore were being cleared automatically. I was not aware that I was using an entire 80GB on the server when I would have been able to get by with about 5. Thirdly, I thought that you were allowed to store some personal files on your account provided that you did use your account to host a legitimate website. The problem with Terms of Service is that they are written in legal jargon that us "normal" people can't understand. I am not just talking about x10Hosting's TOS, but all TOS for different companies/services. My final point here is that although I understand the reasons for my account being terminated, I meant no harm to the x10Hosting. I noticed that earlier, x10Hosting had blacklisted my I.P. address and I could only access the "Account Suspended" page via proxy, but at least now I am able to see the message.

To wrap everything I've said so far, yes, I am begging that x10Hosting please give me a second chance. If the chance is granted, I shall remove my 80GB of data assuming it hasn't already been done, and I shall then dismantle by Duplicati configuration so that it doesn't start uploading files again at 3:00 AM. I ran a legitimate website, and feel like an idiot for this being the cause of my account's termination. Even if "all sales are final", may I at least have back all of the files from my website's root directory? The only reason I backed up my stuff to x10Hosting is because although I have found other alternatives for free FTP storage, they are crappy. Please consider this "take 2" on my appeal despite the words of the appeal saying that "this decision is final."

File Storage: Accounts are not to be used for file storage, your account will be permanently suspended if found to be breaking this rule. Downloads are only allowed on your x10Hosting account if they have to do directly with your website. e.g. you developed custom software and are selling it or giving it away. Accounts may not be used for mirrors, game file hosting, or any other type of file hosting not specified here.
6. System Backups
Backups are the sole responsibility of the customer. x10Hosting retains and offers backups to the customer but does not guarantee this service from failure. It is recommended all customers keep their own backups. Backups will not be provided to account holders who have been suspended for breaching the Terms outlined on this page.

I've bolded the requisite sections; given the extreme level of file hosting discovered on the account (80gb is the LARGEST infringement of file storage I've seen in my time here), in accordance with the Terms of Service agreed to at signup, the suspension is permanent.

As quoted above, we do not allow accounts to be used for file storage. This includes if you have a legitimate site, and leaves little room for error as it puts plainly that we don't allow accounts to be used for file storage.

As this dispute has now been handled twice, this ticket is closed.


Edit: Two clarifications: 5gb of backups would -also- have been grounds for immediate and permanent suspension. I'm unsure what you're referring to by an IP blacklist though, as we don't blacklist IP's of users who have been suspended, however there have been issues lately with Comcast blocking our IP's. While we are working to resolve that, we still aren't able to lift the suspension.
