so I've decided instead of making my site a business I'm going to turn it into an informational site and download haven for cell phone ringers, themes, etc... I realize that I will not be able to host software that's copywritten etc...

But what are the rules governing ringtones, pics, themes etc... specifically related to blackberry and PDA style phones?

As long as the items in question are not copyrighted and are made by you then i would not see any problem. Do not take my word as final say though. I would wait for an Admin to make the final yes or no.

I need some definate ADMIN input here then. This stuff is mostly made by me, as far as the themes go they are all going to be my intellectual property.

But I'd like to place a ringtone section on the site and I know they're songs that are other peoples but I've cut them down, formatted etc... I won't be making money off of them, they'll all be free, but I still need to know FOR SURE if it's against the ToS.

Pretty much, if it's not copyrighted then it's fine. I'm not sure what the deal is with ring tones and copyrights so you might have to look it up.

Do you have any idea of where I might be able to look this up?

I would suggest trying google. Maybe ringtone copyrights or something along them lines. I am sure you are bound to come up with some information.

Also maybe you could invest in a ringtone converter and convert your own :) Then technically they are yours.

This is what I was talking about, I have wavepad and several other items like it that I use to cut MP3's into ringtones.

Then i really can't see it as being a violation. I would wait for admins final approval though. :)

I admit i used to make my own for my cell phone ;)

I don't know how true this is, but I consider ringtones kinda like midis. And if you get the permission from the creator of the ringtone/midi/whatever, then I would think it's appropriate to post it, but that's just my guess.
