copyright question: flash games

If I should upload flash games to my site with a link to authors website will I break the x10 TOS. Yes, I have readed the TOS but I'm from sweden and large english text makes me confuzed. Ok I consentrated more reading this time and found nothing about flash games. But if I understand right, if some user have copyrighted material on his site and the artist or whoever it are founds their work on there it is x10 that must pay the price?!?!? Why isn't it so that the user does pay??? They should take their own responsibility to not post copyrighted material.

Copyrighted material includes anything that is protected by a copyright. It can be anything. x10Hosting does not want to do with anything illegal because it does not want to get bad publicity due to some users.

Even Youtube says that and most of the content on youtube infringes copyright.

But look, Miniclip owns the game and they allow me to embeed it. You guys can just mail miniclips staff and ask about it. I can use the games how I want for them so long I don't break the miniclip TOS and the rules is like no games on porno sites etc.

If they say you can embed it, then you can embed it, because by giving you an embed code, they are giving you permission to embed it.

If the games themselves are created by Miniclip and they are offering the embed code, then I see no problem with it.

You can only copy the game if you have leagal permission from the author and that would not violate the TOS.
