error 552

Hello !
How are you doing today ?

I have a problem.
I tryed tu upload a file this morning, but it failed after 16 MB upolad, with this error code 552 (exceed disks )

Why, since it is supposed to be illimited ?

That limit was put in place on FTP due to a large number of users uploading copyrighted material such as full version videos of unreleased movies.

It also stops some larger MP3's from being uploaded. Unfortunately for you, you apparently missed this part of the terms:

* Illegal Material: This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State, or Local regulation. You may not store copyrighted Mp3s or videos on your webspace in any way shape or form.

In accordance with the x10hosting Terms of Service, your account is now under a permanent suspension for multiple counts of copyright infringement stemming from copyrighted mp3's on your account in clear violation of section 1. In accordance with sections 6 and 8, no further access will be allowed for any reason, and there is no longer any way to recover the account.

I answered you by creating a new ticket.
There is a misunderstanding and I'm sure you will understand my point of view.

There is no copyright violation because of :
1. all these records are mine.
2. visitors CANNOT download music because I put it in a flash-based programm, as you can see on /zing/index.php

That's the rule here in Europe : as far as the music records cannot be downloaded by visitors, there is no copyright-problems.
I do suppose it's the same in USA.

The rule is not the same in the USA. I copied the line -exactly- as it appears in the TOS. It doesn't say "they can be stored as long as they can't be downloaded," it says "You may not store copyrighted mp3's or videos on your webspace in any way, shape, or form."

Also, "All these records are mine" ? Are you saying you are the writer and artist/recording label who made every song? Cause over here stateside, having the mp3 ripped from a cd isn't always legal to begin with.


Oh, and 1.2gb. That's how many you had on here. As I said, it's permanent, even if we just go with "You may not store copyrighted mp3's or videos on your webspace in any way, shape, or form." They were on your account, and as such were stored in your webspace. Accessible or not wouldn't change that you are -still- breaking the terms.

I understand that apparently the copyright-rules are not the same in USA.
I apoligize, but you'd better understand that I thought it was legal.
Otherwise, I would not have uploaded.

Please stop suspending my account and I will delete the music files.
If not, I'd like to take my program files back (not my music but the others), because I have no back-up for it.

You marked the box that said you read and agreed to abide by the terms, and the line in question has been present in the terms since I signed up in 2005. There was no way it was ever going to be tolerated, but especially not 1.2 gb worth of it.


In any case, access to the account cannot be restored.

8. Suspensions

If an account is suspended for a breach of the terms outlined above the account holder will immediately forfeit all rights to the account in question including access to any and all files and\or databases located within the account. x10Hosting is under no obligation to provide backups in full or partial to an account holder that has been suspended.

Under section 8, once suspended for a breach of the terms that were outlined above (which included your violation from section 1), all access rights were forfeited and we aren't under any obligation to provide backups. Under section 6 you're responsible for them anyways - if you don't have any, that's not something I can help with anymore at this point.


Ticket closed; there's nothing you can do at this point.
