You had to agree to the terms to sign up for the hosting; the box says "I have read and agree to abide by the TOS" which you failed to do on both counts apparently.
The account remains suspended for a minimum of 14 days; sometime thereafter it is terminated off the system and can be recreated. The problem is the minimum of 14 days part - there's no real idea -when- after 14 days it erases. There's other permanently suspended accounts out there that have been suspended for the last 40-50 days, so it might be a while.
