There was something I'm reminded of here actually....McDonalds were taken to court not long ago becuase someone bought a cup of coffee from them, took it to their car, placed it on their dashboard, and drove off. It fell into their lap, and they were burned. The person won the case because the cup did not have "Caution. Contents may be hot" written on the side. :)

This same instance can be taken to extreme levels.

What if the coffee spilled into the radio or something? McDonalds shouldn't have to write "Caution: Contents may consist of liquid" on the side.

No, she won the case becaus McDonalds was negligent in serving a product at dangerous temperatures.

McDonald's required franchises to serve coffee at 180–190 °F (82–88 °C ). At that temperature, the coffee would cause a third-degree burn in two to seven seconds

Other documents obtained from McDonald's showed that from 1982 to 1992 [the incident took place in 1992] the company had received more than 700 reports of people burned by McDonald's coffee to varying degrees of severity, and had settled claims arising from scalding injuries for more than $500,000. McDonald's quality control manager, Christopher Appleton, testified that this number of injuries was insufficient to cause the company to evaluate its practices. He argued that all foods hotter than 130 °F (54 °C) constituted a burn hazard, and that restaurants had more pressing dangers to warn about.

She originally asked for $20K to cover $11K medical bills plus suffering. McD's offered $800.
Judge/jury awarded her $680K and to avoid appeals the parties settled out of court afterward.

This reminds me of a character in Hitchhiker's Guide to the Galaxy.

A guy named Wonko the Sane built his house so that the "garden" and "courtyard" were inside the walls, and the walls to the outsider world were decorated like the insides of an asylum. He said that he was the only person living outside of the asylum, and thought the world needed to be committed.

Hold stick near centre of its length. Moisten pointed end in mouth. Insert in tooth space, blunt end next to gum. Use gentle in-out motion.

It's coffee for f**ks sake (and not iced coffee..)... I say, remove the health and safety warnings from everything and let natural selection take its place...

the lady is dumb. if i was the jury i would had supported mcd, it's common sense the cofee is hot and can burn you, instead the court should had fine the lady for waste of time.

It's people who don't use their common sense that need to be sued technically. Hot cup of coffee which you take with your hands and can feel it's hot, wouldn't you think "Hey, I better not put this someplace where it'll fall on me?" or for that matter, put it in a secure location so it doesn't damage anything? Many things I've seen fast food restaurants get sued for were due to a consumer's lack of common sense. Companies shouldn't need to plaster labels over everything that you can detect with your senses or determine using 4 year old knowledge. Think about it this way. You feel heat, you drink a very warm, liquidy substance, and you can see the steam coming out of it. What'd be the first thing you think before you even sense the taste of it?

Of course that's my stance. I've burned myself by spilling a couple drops of coffee on myself while bringing it to another person so many times, I've grown used to it.

I just think this is a perfect example of how stupid some countries are getting... Just like in the UK where you go on a train and every second window has a safety instructions notice, you get told to "mind the step" at every stop, and get told that the aforementioned safety notices are "located throughout this train" every few stops (contrast with central european trains with possibly one small notice per carriage and no special safety notices -- or is it really not that obvious that you shouldn't stay in a burning train, that you shouldn't stay on the tracks etc.) . The fact that McD can get sued for something like this is just fuelling the silly Health and Safety Mania present in the UK (and presumably US). It seems that there is a border between mainland Europe and countries further west, where common sense gets lost.

(If I spilled coffee like this I would accept that I was just a big dumbo and get over it... However some people don't seem to be able to accept that things are THEIR OWN fault, and want to get retribution for someone else's mistakes... I have cut myself badly with a stanley knife, burned myself with a soldering iron, and didn't sue the makers for not including a "Warning, sharp" or "Warning, hot" sign on them -- it was after all MY stupidity that caused this. I could easily find many more examples like this...)

Next you'll have deceased's relatives suing hospitals for having helped bring the person to life, since this was the cause of their death, or at least not warning that life has a high probability of death...

(If I spilled coffee like this I would accept that I was just a big dumbo and get over it... Yeah, you guys remember that lawsuit where some guy sued KFC because he claimed that their food was addictive and blamed them for his heart problems? I think it was thrown out.
