Greetings to all member of X10.
Especially to All officer and moderator of X10.

Since you create a new policy that is the limitation of space on hosting, I think that it is the best policy for us all. That way, the performance of x10hosting could go untreated. As well, x10 hosting is not used by certain elements.

To that, in order not to reduce the policy above, then I asked the officer in here to check my account.
Please give me criticism and warn if I violate this hosting TOS. But, if I already meet the requirement criteria for an upgrade policy and I don't break the hosting rules, so I request the officer here to upgrade my web space.

Do you have the translation and redistribution rights from the makers of all the manga on your site? If not, that'd be Copyright Infringement and thus a TOS violation.

In addition, the primary language of the site is Indonesian, not English/Spanish/French as required by the TOS.

I'm sorry, this manga just fan made. Not like you say, if i redistribute it then I obviously violating copyright. But I do not distribute with the profit. Anyway, I just put up manga aimed at readers who are from Indonesia, not global. Manga that I put in this site, just a manga that has not been publish to Indonesia. If manga had been published in Indonesia, then I will not put into the site. In addition, the translation of the manga in this site is still so far from perfect. Because, the manga in this site is intended for review only, not as a reference, also supported by the newbie translators who has not been adept at translating.
A few quote in my site:
"Do not try to profit from this material. If you liked any of the manga you obtained here, consider buying the Japanese versions, or the local translation, where available. Thanks for your support. "

Once again, I'm very apologize for my impolite behavior. Have you visited my site? Don't judge my site in Indonesia Language just because you read an Indonesian phrase in my site header and chapter title of my translate manga.
My site is full English language. Except, "my header" and my translate manga (Chapter title).

Fact 1: Redistribution of copyrighted material without monetary gain is -still- illegal.

Fact 2: The majority of the content on your site is not in English, Spanish, or French, and thus is not in line with the TOS. Yes, the manga are included in this.

Fact 3: Fan translations are indisputably illegal (Article 8 of the Berne Convention explicitly reserves the right of translation to the copyright holder and whoever receives permission of them, saying "Authors of literary and artistic works protected by this Convention shall enjoy the exclusive right of making and of authorizing the translation of their works throughout the term of protection of their rights in the original works.") One note to make as well is that your argument seems to be "It's the fan translation." Did the original copyright holder, Sasuga Kei (and presumably the company he works for), contractually authorize the translation of his manga by your fan-subbing group? If not, then it's not legal - the Berne Convention basically boils down to "I reserve the rights to have my works translated if I so choose, and by whom I so choose, and no one else."

So again, this still doesn't abide by the TOS. Based on what you've told me, the manga on the site are Fansubbed because Sasuga Kei did not authorize a translation to be released in India. That puts this in copyright infringement. I can understand the logic of trying to run such a website to try and bring the material into India, but it's not one the TOS for x10hosting will allow.


You have 24hr to bring the site in line with the TOS.


Edit: Googling for "Are fan translations legal?" will bring up some interesting results as well; it brings up an entire site for a sailor moon translation group who flat out admit everything on their site is illegal for them to distribute, and illegal to be downloaded, under the Berne Convention. It's worth a good read if you plan on distributing fan translations through other providers (for the aforementioned reasons it isn't allowed here due to being illegal).

As a final note, the disclaimer doesn't mean much - you're still responsible for the content on the site, which isn't legal. If this is coming off as harsh or rude, I do apologize for that, but the fact of the matter is what you're doing with the site is not legal in US law, and since we're based in the US, it's US law that has to be followed.

I don't know, what can i do. All of my files in your host. My hard work for nothing?

I waiting for you suspend my site. Delete all my files, clean my "illegal" in your host.
Your host is too perfect. Your host really follow the actual rules are still in the gray areas.

x10hosting is very strict about it's TOS, even in paid plans.

For mangareader and mangafox, they aren't hosted on x10. If they were, they'd be offline. We cannot police sites that aren't hosted on our services, and some hosts are more lax when it comes to enforcing their users. In any case, since you've refused to remove the copyright infringing material, the account has been permanently suspended.

Just as a side note before closing this ticket however, I'd like to point out that you referenced MangaReader as a US site - it's hosted in Germany. Granted, Germany is still covered by the Berne Convention, but I like to push for accuracy whenever possible.
