Question about the TOS

In the Terms of Service, I read this:

Advertisements are to be placed in such a spot so that the end-user can view them without having to scroll down on the page.

But in this forum I've also read that only in the Advanced plan, you can put them wherever you want, as long as they are on every public page.

So I just want to know if in http://colodro.x10hosting.com/ the ad has been put correctly. And if there is something that is violating the rules (though I've read them hundred of times), please tell me.

If you have a corporate account then you must have the ad's at the top of every page and the advanced ad's maybe placed anyware.

But... why don't you put that in the TOS so that everybody will know it? Because as it is now it can be a bit confusing :S

If everyone reads the TOS (I'm sure many people haven't) and they think all ads must be at the top of the page, even Advanced ads, then there will be less confusion. Better safe than sorry.
