I am making my friends band a site (cascades.exofire.net), And I was wondering if uploading the bands songs to download is against the TOS. Just wondering

If the songs are copyrighted in ANYWAY we must have permission from the copyright holder of said music in order to have them on the server. If they are NOT copyrighted then that is fine. (As far as I know)

It's fine if they, or you, are the original owners and give you permission, and if the files are not copyrighted by someone else who doesn't give permission.

Work is copyrighted automatically as soon as it is created. Just say "you must be the copyright holder or have the copyright holder's permission" or something like that.
