Your right it is not an arguement because I don't need to argue with you. How can you prove it....that is not up to us, it's up to you.
if broke the copyright, that can be prove.
if not, then cannot.
If you stole a bike, that can be proved.
If you buy a bike, that can be too (bill)
But if make yourself something (mp3, php script, anything), and you don't copyright it, then how the hack could you prove that isn't copyrighted by somebody else?
In this case the original author, or some organization, wich represent the author have to prove that is copyrighted by them, and make you remove it.

You can't do that, to not letting them in with this:
"You looks like thugs, I don't let you in, because I would be charged for helping criminals..."
You can call the police, and so, but it's not your responsibility or duty to decide who is a bad guy, and who isn't.
