I've misunderstood the Terms and Conditions which lead me to cause an offence which I did not meant to and I enjoyed the hosting from this website and if I were to upgrade to x10Premium would I still be able use it for File Hosting?

From the x10Premium Terms of Service:

3. Content Restrictions
x10Hosting does not allow the use of it's services for illegal activities. This includes hosting of copyrighted material, nulled scripts, or anything that is considered illegal under US law. A suspension leading up to termination will be imposed for a breach of these terms. While we strive to accommodate all types of sites our shared hosting may not be used for the following:
  • File or Image Hosting Sites
  • Proxies
  • Download scripts such as but not limited to Rapidleech and TorrentFlux
  • Backup Space \ File Storage
  • Mirrors for software or game files

Upgrading to premium wouldn't work for any form of file hosting; you would need to look for a host specifically designed to host files, and in the case of game file hosting, you'd need to find one that also allowed a fairly substantial amount of bandwidth - game files for popular servers can suck up bandwidth faster than you might think.

Does this mean SWF games are illegal? Just trying to stay out of trouble

SWF games should be fine, just be mindful of this other section:
  • Flash Arcades: Flash arcade sites are limited to 1GB of disk space for the game files.
When they're referring to game file hosting, we mean ones not directly related to the site you're running - we've had lots of disk usage problems in the past due to users utilizing us as a FastDL server for counterstrike, garry's mod, habbo retro emulators (which are illegal in themselves anyways), and a few for Unreal Tournament 2003/2004. For SWF arcades, the games are related to the site since you'd have to make a site to make them usable, we just don't want it going over 1gb (there's only been a few users I know of that went over 1gb of flash games, but they went way over).

Thanks for the clarification (which I thought was correct). Does the 1gb limit only for the "free-hosting" or is that also for a paid account or would I need a VPS? (definitely not yet, just asking.)

There's no hard cap listed in the Premium ToS for it, but I'd recommend using the "Contact Us" link on the bottom of x10premium.com just to be safe. There is a section in the ToS for premium involving hitting 75,000 inodes (files and/or folders) and 10gb disk though, but that just covers being removed from the automatic backups; if you did get it that big with a flash arcade though, by that point you'd likely need a VPS to handle it anyways.
