I think this has been asked many times, And i'm quite sure your not allowed. But I'll double check just to be sure.

u should be since they have a a thing like right above the public_html file...

The site must be used for more than just an upload place. In other words there must be a working site up with ads on it in a week I think it is. If you have a working site then your members of your site or the ppl that visit it are allowed to upload files and download them as long as they adhere to the T.O.S. You MAY NOT have just a file upload site.
