A friend came to me and asked me a question about a site that he wants to start. Before referring him to use x10 I wanted to make sure that his site wouldn't violate your ToS.

Ultimately what his website idea comes down to is a forum linking/review site. He wants to create a forum where people can post links and reviews on various topics like movies, games, applications, etc....

I have foresight and can see the possibility of people posting links to movie streams, 'off-site' file downloads, links to torrents, etc......

Not to say this will happen but it is a possibility.

So my question is, if my friend isn't actually storing any downloadable content but users post links linking to off-site applications would this be considered a violation of the TOS regarding 'No Warez"?

1. Make sure that the site software has anti-spamming enabled

2. Create Sub-Forums that do not draw illegal links. "Seeing the film before it comes out" would be a bad choice of sub-forums.

3. Make it clear to the Forum members that such links are not allowed.

4. He has to monitor the Forum. Periodically check the new posts and delete/edit any ones that break the TOS.

so then in turn posts containing links to offsite games, movies etc would be considering breaking the TOS

If he allows them to stay there, yes. He is not expected to remove them with 10 seconds of the post. Even the Forum here gets some spam posts with links that have to be deleted. Someone has to notice and then remove them.

If a thread full of links stays on his site for a week, it might be viewed like he condones such links and would be dealt with accordingly.

Just a clarification, those links would only be disallowed if the sites they link to offer illegal downloads of said game, movie etc. Linking to a site with an official trailer, or more information etc, would for instance be fully allowed.
